1. Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Idynic ("we," "us" or "our"), concerning your access to and use of the Idynic website and mobile application (collectively, the "Service").

By accessing the Service, you confirm that you have read, understood, and agreed to be bound by all of these Terms of Service. If you do not agree with all of these terms, then you are expressly prohibited from using the Service and you must discontinue use immediately.

2. Intellectual Property Rights

Our IP

Unless otherwise indicated, the Service is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Service (collectively, the "Content") and the trademarks, service marks, and logos contained therein are owned or controlled by us or licensed to us.

Your Content

You retain full ownership of all resumes, documents, and data you upload to the Service ("User Content"). By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and process your User Content solely for the purpose of providing and improving the Service to you (e.g., parsing your resume, generating suggestions).

3. User Representations

By using the Service, you represent and warrant that:

  • All registration information you submit will be true, accurate, current, and complete.
  • You will maintain the accuracy of such information and promptly update such registration information as necessary.
  • You have the legal capacity and you agree to comply with these Terms of Service.
  • You will not access the Service through automated or non-human means, whether through a bot, script, or otherwise.
  • You will not use the Service for any illegal or unauthorized purpose.

4. AI Services Disclaimer

Our Service utilizes Artificial Intelligence ("AI") to generate content, suggestions, and insights. You acknowledge that:

  • AI-generated content may not always be accurate, complete, or suitable for your specific needs.
  • You are responsible for reviewing and verifying all AI-generated content (e.g., resumes, cover letters) before using it for job applications or professional purposes.
  • We do not guarantee that the use of our Service will result in job interviews, offers, or employment.

5. Prohibited Activities

You may not access or use the Service for any purpose other than that for which we make the Service available. Prohibited activities include, but are not limited to:

  • Systematically retrieving data or other content from the Service to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
  • Circumventing, disabling, or otherwise interfering with security-related features of the Service.
  • Disparaging, tarnishing, or otherwise harming, in our opinion, us and/or the Service.
  • Using the Service to generate content that is fraudulent, deceptive, or misleading.

6. Billing and Subscriptions

Subscription Plans

The Service offers both free and paid subscription plans. Paid plans provide access to additional features as described on our pricing page. By subscribing to a paid plan, you agree to pay the applicable fees.

Payment Processing

All payments are processed securely through Stripe, our third-party payment processor. By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge the applicable fees.

Auto-Renewal

Paid subscriptions automatically renew at the end of each billing period (monthly or annually, depending on your plan) unless you cancel before the renewal date. You will be charged the then-current subscription rate upon renewal.

Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period. No partial refunds will be issued for unused time within a billing period.

Refund Policy

We offer a 7-day money-back guarantee for new subscriptions. If you are not satisfied with the Service, you may request a full refund within 7 days of your initial subscription purchase by contacting support@idynic.com. Refunds are not available for renewal charges or after the 7-day period.

Price Changes

We reserve the right to modify subscription pricing at any time. Price changes will not affect your current billing period. We will provide at least 30 days' notice before any price increase takes effect for your subscription.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that (a) the Service will function uninterrupted, secure, or available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; or (d) the results of using the Service will meet your requirements.

8. Limitation of Liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Service, even if we have been advised of the possibility of such damages.

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
